A DEFENDANT who refused to provide a breath sample was banned from driving for four years at Kilkenny Court.

A DEFENDANT who refused to provide a breath sample was banned from driving for four years at Kilkenny Court.

The court heard that the defendant, Gerard Kavanagh, 60 Glendine Heights, Castlecomer Road was arrested on suspicion of drink driving at Kilkenny Garda Station on August 7, 2010.

The court heard the defendant is a 30-year-old unemployed carpenter who had a serious drug problem in the past but has been drug-free for several years. The defendant claimed that he was drug free and hadn’t taken alcohol on the date in question and was in shock and became stubborn following an accident and refused to provide a sample to gardaí.

Judge David Anderson fined him €250 and imposed a four-year disqualification order.
