Permission refused for pair of houses on agricultural land

Planning permission for Kilkenny Co-Operative Livestock Market Limited to build two houses Leggetsrath East, Dublin Road, Kilkenny as been refused by Kilkenny County Council.

The group had applied for “outline permission for two two-storey houses on individual sites with individual entrances, individual domestic garages and individual treatment systems.”

The council ruled, however, that it would be “speculative” to grant outline permission because the land is zoned for agricultural use and therefore housing would be restricted to members of the land-owning farmer’s immediate family or someone whose “primary employment is in agriculture, horticulture, forestry or bloodstock, or other rural based activity in the area which they wish to build.”

“In this case, the application is for Outline Permission and therefore no details of the applicants have been provided,” the council said in its decision. “As such, this is a speculative development which is contrary to ... the Development Plan.”
