Wind turbine is an ‘exempted development’

A WIND turbine located at a site at The Rower has been deemed by An Bord Pleanála to be an “exempted development,” which could have implications for others installing wind turbines.

In a decision issued recently, the board ruled that the installation of a GEOL 3 VAWT wind turbine at Newfarm, The Rower, County Kilkenny was exempted development. In making its decision, the board said it considered current planning regulations, the County Development Plan, the topography of the area, the nature and scale of the wind turbine, and the voltage of electricity transmitted.

The board found that “the erection of a wind turbine would come within the scope of the exempted development provisions of (national planning regulations)” and that “the said wind turbine would not interfere with the special character of the landscape...”
