The driver of a car discovered by gardaí on its roof and extensively damaged, has been convicted of drink driving at Kilkenny District Court.
Vadym Toderiko, who at the time was living in a hotel in Kilkenny, pleaded guilty to the charge, and other motoring offences, through his solicitor Chris Hogan.
The court heard that on July 21, 2023, gardaí received a report of a single vehicle accident at Danesfort.
At the scene gardaí found the car had overturned, was on its roof with extensive damage. The driver had left the vehicle.
After caution, Mr Toderiko told gardaí he had had two glasses of wine and then went for a drive.
A passenger in the car had a cut to their head. They received treatment at the scene but declined to go to hospital.
Mr Toderiko was taken to Thomastown Garda Station where a breath test showed a level of 128mcg of alcohol per 100mls of breath.
Judge Geraldine Carthy observed that the level of intoxication was ‘more like two bottles’ of wine than two glasses.
The court heard Mr Toderiko was very cooperative with gardaí.
Mr Hogan said his client is from Ukraine. He left because of the war and still had family members there. This was causing him concern and led to him drinking to excess.
The incident was a ‘wake up call’ for his client, Mr Hogan said. He is now working in Canada.
Judge Carthy convicted Mr Toderiko of drink driving and disqualified him from driving for two years. He was also fined €500.
For not having a driving licence he was fined €300 and other charges were taken into consideration.
