Kilkenny family drop High Court challenge because of progress on surrogacy legislation

A Kilkenny couple who took a High Court case to establish parental recognition of the genetic mother of their son born through surrogacy, have dropped the legal challenge.


Brian and Kathy Egan say they are encouraged by the progress being made to introduce legislation that will address the issue.


Last Thursday, April 20, Minister for Health, Stephen Donnelly, told the Dáil that drafting of the legislation is well underway and he hopes it will be signed by President Higgins before the summer Dáil recess.


A Ukrainian woman carried and gave birth to the Egan’s son Luke, in 2019, under a surrogacy agreement. Mr Egan is legally recognised as his father but Mrs Egan is his legal guardian, which will lapse when he turns 18.


“It is going to be a great day when we pass this legislation and rightly recognise these children, their rights and the rights of their parents. It will be a very important day and it will happen this year. I know people have been waiting a long time,” Minister Donnelly said.
