Says he paid for insurance – still fined: Kilkenny case exposes payment glitch?

A Kilkenny solicitor has sounded an alert for motorists who pay their insurance policy through monthly installments - after a second case where a client had their policy cancelled due to an error, without them being informed.

Chris Hogan, who was representing a client before Kilkenny District Court on a charge of driving without insurance, said there seemed to be a problem between Revolut bank and certain insurance companies.

Demands for monthly payments are not being fulfilled, even when there is sufficient funds in the policy holder’s account to meet the charge.

The issue was raised in defence of Michael Boland, 5 College Court, Cahir, Co Tipperary, who appeared before the court on a charge of driving without insurance.

Inspector Alma Molloy said Mr Boland was driving at the Callan Road, Kilkenny, on January 2, 2025, when he was stopped by a garda. It was discovered the vehicle was not insured and it was seized.

Mr Hogan said his client had an insurance policy that he was paying by installments. It was only when his vehicle showed as uninsured on the garda ANPR device that he discovered the policy had been cancelled.

At the roadside he first called his partner, who knew nothing about it, then his insurance company who confirmed his policy had been cancelled.

Mr Boland was “absolutely sure” when he set off that day that he was insured, Mr Hogan said.

His client took out a fresh insurance policy the next day, with a different company, and has lodged a formal complaint with his original insurance company.

Judge Geraldine Carthy convicted Mr Boland and imposed a fine of €200. In the circumstances no disqualification was imposed.
