Time's up for uninsured e-scooter driver who ‘passed Kilkenny Garda Station every day’

A man who said he drove past the garda station ‘every day’ and was not told his e-scooter needed to be insured until the day it was seized by a garda, has been convicted of driving without insurance at Kilkenny District Court.

Przemyslaw Biniechi, 32 Lintown Avenue, Kilkenny, pleaded guilty to the charge.

Garda Andy Neill told the court that on November 10, 2025, at 6pm, he stopped an e-scooter at the Old Callan Road.

The machine was not insured and when it was tested on an approved device reached a top speed of 62kph; the legal top speed for an e-scooter is 20kph. Over that speed the machine is classed as an insurable mechanically propelled vehicle.

Mr Biniechi, speaking in court, said he did not know the e-scooter was illegal. He said he bought the e-scooter last year.

He drove past the garda station every day and even in the shop where he bought the e-scooter the staff didn’t tell him it had to be insured.

Judge Geraldine Carthy commented that they should have.

Mr Biniechi told the court he did not have a driving licence as he cycles.

Judge Carthy convicted Mr Biniechi and imposed a fine of €200.
