A man appearing in court on his fourth no insurance charge has been convicted and disqualified from driving.

Brian Feeney, Jerpoint West, Thomastown, was stopped by gardaí while driving at Quarryland, Kilkenny, on August 7 last, just after 6pm.

Mr Feeney was driving a UK registered Jaguar car.

A check on the garda mobility app showed the car’s insurance had expired and had no UK MOT, tax or insurance.

When asked for his documents, Mr Feeney initially claimed ‘everything was ok’ in the UK, Sergeant Morgan O’Connor told the court. When he was challenged on this, by the garda, Mr Feeney said he had his driving licence at home. He later admitted he was serving a driving disqualification.

He was charged with driving without insurance or a licence. He entered guilty pleas to both charges.

Mr Feeney had nine previous convictions, the court was told.

Judge Geraldine Carthy noted that this was Mr Feeney’s fourth time before the court on a no insurance charge.

Solicitor Chris Hogan said his client had been driving on the day because he had a physiotherapy appointment, as he suffers from chronic pain, and all his lift options had let him down.

Being ‘off the road’ has consequences for his client’s business and family, Mr Hogan said, but he accepted he was getting a disqualification.

Convicting Mr Feeney of driving without insurance, Judge Carthy disqualified him from driving for four years and handed down a fine of €750. The other charge was taken into consideration.
